What Should a Wife Do If Her Husband Marries Again or Has an Extra-Marital Affair?अगर पति दूसरी शादी करे या किसी और से संबंध रखे तो पत्नी क्या करे?

 


Introduction

In India, marriage is considered a sacred bond and is protected by law. However, if a husband enters into a second marriage without obtaining a legal divorce, or engages in an extra-marital affair, the law provides the wife with strong legal protections and effective remedies.

प्रस्तावना 

भारत में विवाह एक पवित्र बंधन माना जाता है, जिसे कानून द्वारा संरक्षण प्राप्त है। किन्तु यदि कोई पति अपनी पत्नी को विधिक रूप से तलाक दिए बिना दूसरी शादी कर लेता है या किसी अन्य महिला के साथ अवैध संबंध रखता है, तो कानून पत्नी को असहाय नहीं बल्कि सशक्त बनाता है और उसे मजबूत कानूनी अधिकार प्रदान करता है।

 If Husband Contracts a Second Marriage (Updated Law)

Under Section 82 of the Bharatiya Nyaya Sanhita, marrying again during the lifetime of a legally wedded spouse amounts to the offence of bigamy.

Such second marriage is void and punishable under law.

यदि पति दूसरी शादी करे (नवीन कानून के अनुसार)

भारतीय न्याय संहिता की धारा 82 के अनुसार, यदि कोई व्यक्ति अपनी विधिवत जीवित पत्नी/पति के रहते दूसरी शादी करता है, तो यह द्विविवाह  का अपराध है।

ऐसी दूसरी शादी शून्य  मानी जाएगी और दंडनीय होगी।

Punishment:सजा


 Imprisonment up to 7 years and fine.
7 वर्ष तक का कारावास और जुर्माना।

Extra-Marital Affair (Current Legal Position)

The Supreme Court of India in 2018 decriminalized adultery.

However, it remains a valid ground for divorce under the Hindu Marriage Act.

अवैध संबंध की वर्तमान कानूनी स्थिति

सर्वोच्च न्यायालय ने 2018 में व्यभिचार को अपराध की श्रेणी से हटा दिया।

किन्तु यह अब भी हिंदू विवाह अधिनियम, 1955 के अंतर्गत तलाक का वैध आधार है।

What Can a Wife Do? (Legal Steps)

  • Injunction (Stay Order): If you have proof that your husband is planning a second marriage, you can approach a Civil Court to get a permanent injunction to stop the marriage.

  • Maintenance: Under Section 125 of CrPC (now BNSS), a wife is entitled to claim monthly maintenance for herself and her children if the husband deserts her or has an affair.

  • Domestic Violence Case: An extra-marital affair is considered 'Emotional & Mental Cruelty'. A wife can file a case under the Protection of Women from Domestic Violence Act, 2005, seeking residence rights and compensation.

  • Divorce: A wife can seek a decree of divorce on the grounds of adultery and bigamy.

पत्नी क्या कदम उठा सकती है? (कानूनी उपाय)

  • निषेधाज्ञा (Stay Order): यदि आपको पता चले कि पति दूसरी शादी करने वाला है, तो आप सिविल कोर्ट से उस शादी को रुकवाने के लिए 'स्टे ऑर्डर' ले सकती हैं।

  • भरण-पोषण (Maintenance): CrPC की धारा 125 (अब BNSS) के तहत पत्नी अपने और अपने बच्चों के लिए पति से मासिक खर्चे की मांग कर सकती है।

  • घरेलू हिंसा (DV Act): पति का किसी और से संबंध होना 'मानसिक क्रूरता' है। पत्नी घरेलू हिंसा अधिनियम के तहत रहने का अधिकार और मुआवजे का केस कर सकती है।

  • तलाक (Divorce): दूसरी शादी और अवैध संबंध के आधार पर पत्नी कोर्ट से तलाक की डिक्री मांग सकती है।
